GENERAL CONDITIONS OF SALE

These general terms and conditions of sale apply to the sale and purchase of “MARIA PATRIZIA MARRA JEWELS” branded products concluded between Maria Patrizia Marra, headquartered in Rome 00167, Tax Code MRRMPT61D66F842Y, VAT number and registration number with the Companies’ Register of Rome no. 07364600580 (hereinafter, “Maria Patrizia Marra Jewels“) and any individual who makes online purchases on the website

, hereinafter referred to as “Customer”.

These general conditions govern all purchases completed through the website
www.mariapatriziamarra.com
, in accordance with the provisions of Leg. n. 206 of September 6, 2005, as amended (hereinafter, the “Consumer Code“).

ARTICLE 1 – Subject of the contract

By these general conditions of sale, Maria Patrizia Marra Jewels sells and the CUSTOMER purchases at a distance the tangible movable goods indicated and offered for sale on the website

. The contract is concluded exclusively through the Internet, by means of the CUSTOMER accessing www.mariapatriziamarra.com and placing a purchase order according to the procedure provided by the website itself.
The customer undertakes to read, before proceeding to confirm his order, these general conditions of sale, in particular the pre-contractual information provided by Maria Patrizia Marra Jewels.

ARTICLE 2 – Pre-contractual information for the consumer – Article 49 of Legislative Decree 206/2005.

The CUSTOMER, prior to the conclusion of the purchase contract, shall take note of the characteristics of the goods, which are illustrated in the individual product sheets at the time of selection by the CUSTOMER.
Before the conclusion of the purchase contract and before the validation of the order with “obligation to pay”, the CUSTOMER is informed regarding:
– total price of goods including taxes, with details of shipping and any other costs;
– method of payment;
– The deadline by which Maria Patrizia Marra Jewels agrees to deliver the goods;
– conditions, terms and procedures for exercising the right of withdrawal (Article 6 of these conditions) as well as the withdrawal form in Annex I, Part B of Legislative Decree 21/2014;
– information that the CUSTOMER will have to bear the cost of returning the goods in case of withdrawal;
– Existence of the legal warranty of conformity for the purchased goods;
– conditions of after-sales service and commercial guarantees provided by Maria Patrizia Marra Jewels.
The CUSTOMER may at any time and in any case before the conclusion of the contract, become acquainted with the information about Maria Patrizia Marra Jewels, the geographical address and e-mail address.

ARTICLE 3 – Conclusion and effectiveness of the contract.

The contract of sale is considered concluded with the sending by Maria Patrizia Marra Jewels to the CUSTOMER of an e-mail confirming the order. The e-mail contains the CUSTOMER’S information and order number, the price of the goods purchased, the shipping charges and delivery address to which the goods will be sent, and the link so that the CUSTOMER can print and file a copy of these conditions.
The CUSTOMER agrees to verify the accuracy of the personal data contained therein and to promptly notify Maria Patrizia Marra Jewels of any corrections.

The CUSTOMER has the option to cancel the order placed no later than one hour after receiving the confirmation email. Maria Patrizia Marra Jewels strives to describe and present the items sold on the site in the best way possible. Nevertheless, some errors, inaccuracies or small differences between the site and the actual product may show up. In addition, photographs of the products presented on www.mariapatriziamarra.com do not constitute a contractual element, as they are representative only.

ARTICLE 4 – Availability of products

Product availability refers to actual availability at the time the CUSTOMER places the order. However, this availability should be considered purely indicative because, as a result of the simultaneous presence on the site of several users, products may be sold to other CUSTOMERS before the confirmation of the order.
Even after the order confirmation email sent by Maria Patrizia Marra Jewels has been sent, cases of partial or total unavailability of goods may occur. In this eventuality, the order will be rectified automatically with the deletion of the unavailable product and the CUSTOMER will be immediately informed by e-mail.
If the CUSTOMER requests cancellation of the order, terminating the contract, Maria Patrizia Marra Jewels will refund the amount paid within 15 days from the day Maria Patrizia Marra Jewels became aware of the customer’s decision to terminate the contract.

If the CUSTOMER requests cancellation of the order, under the terms of Article 3, Maria Patrizia Marra Jewels will refund the amount paid within 15 days of becoming aware of the CUSTOMER’s decision to terminate the contract.

ARTICLE 5 – Method of payment

Any payment by the CUSTOMER may be made only by credit cards via PayPal at
www.mariapatriziamarra.com
or by bank transfer.

In the event that the chosen method of payment is bank transfer, it should be noted that only payments sent no later than 48 hours after the order will be accepted, and that beyond that time the order is to be considered cancelled.

ARTICLE 6 – Prices

All product sales prices shown on the website
www.mariapatriziamarra.com
are in Euros and include VAT.
Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before payment is made.
The CUSTOMER accepts Maria Patrizia Marra Jewels’ right to change its prices at any time, however, the merchandise will be invoiced based on the prices listed on the site at the time the order is created and indicated in the confirmation e-mail sent by Maria Patrizia Marra Jewels to the CUSTOMER. Shipments outside the European Union, involve the payment of import taxes, which are the sole responsibility and liability of the customer.
In the event of a computer error, manual, technical, or any other nature that may result in a substantial change, not foreseen by Maria Patrizia Marra Jewels, in the sale price to the public, making it exorbitant or clearly derisory, the purchase order will be considered invalid and cancelled and the amount paid by the CUSTOMER will be refunded within 30 days from the day of cancellation.

 

ARTICLE 7 – Right of withdrawal

In accordance with applicable legal provisions, the CUSTOMER has the right to withdraw from the purchase without penalty and without specifying the reason, within the period of 15 days under Art. 57 of Legislative Decree 206/2005 effective from the date of receipt of the products.
The CUSTOMER who intends to exercise the right of withdrawal must notify Maria Patrizia Marra Jewels by means of an explicit declaration, which may be sent by registered letter with return receipt to the address:

The CUSTOMER may also exercise the right of withdrawal by sending any explicit statement containing the decision to withdraw from the contract.
In case of exercising the right of withdrawal, the CUSTOMER is required to return the goods within 15 days from the day he/she notified Maria Patrizia Marra Jewels of his/her wish to withdraw from the contract to the address:

The direct costs of returning products are borne by the CUSTOMER.
The goods must be returned undamaged, unused, in the original packaging, complete in all its parts (including packaging and any documentation and ancillary equipment) and complete with the attached tax documentation. Under no circumstances will merchandise that has not been returned in perfect condition be replaced or refunded.

Without prejudice to the right to verify compliance with the above, Maria Patrizia Marra Jewels will refund the amount of the products subject to withdrawal within a maximum period of 30 days, excluding the shipping costs incurred to the extent of € 15 for Italy and of € 35 for other countries Europeans and €50 for non-European countries.
As stipulated in Art. 56 paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, Maria Patrizia Marra Jewels may suspend the refund until receipt of the goods or at the discretion of the same until CUSTOMER demonstrates that it has returned the goods to Maria Patrizia Marra Jewels.
Maria Patrizia Marra Jewels will make the refund using the same means of payment chosen by the CUSTOMER at the time of purchase. In the case of payment made by bank transfer, and if the CUSTOMER intends to exercise his/her right of withdrawal, he/she must provide Maria Patrizia Marra Jewels, by accessing the contact section or by sending an email to the address  info@mariapatriziamarra.com , the bank details: IBAN, SWIFT and BIC needed to make the refund.

 

ARTICLE 7bis – Change measure on International orders

In accordance with applicable legal provisions, CUSTOMER has the right to request, with exclusive reference to ring purchase, the change of measure within the period of 15 days starting from the date of receipt of the products.
The CUSTOMER who intends to exercise this right must notify Maria Patrizia Marra Jewels by means of an explicit declaration, which may be sent by registered mail with return receipt, including by sending any explicit declaration.
If this right is exercised, the CUSTOMER is required to return the goods within 15 days from the day on which he/she notified Maria Patrizia Marra Jewels of his/her will pursuant to Art. 57 of Legislative Decree 206/2005.

The direct costs of returning products are borne by the CUSTOMER.
The goods must be returned undamaged, unused, in the original packaging, complete in all its parts (including packaging and any documentation and ancillary equipment) and complete with the attached tax documentation. Under no circumstances will merchandise that has not been returned in perfect condition be replaced or refunded. Without prejudice to the right to verify compliance with the above, Maria Patrizia Marra Jewels will proceed with the change of measure  within a maximum period of 14 days (subject to availability), charging the Customer a cost of € 15 for Italy, by €35 for other European countries and €50.00 for non-European countries, as the amount of shipping of goods subject to exchange.
As stipulated in Art. 56 paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, Maria Patrizia Marra Jewels may suspend the exchange of goods until receipt of the goods or at its own discretion until the CUSTOMER has demonstrated that it has returned the goods to Maria Patrizia Marra Jewels.

ARTICLE 8 – Methods of delivery

Maria Patrizia Marra Jewels will accept orders for delivery worldwide. The products will be delivered by express courier to the address indicated by the CUSTOMER when placing the order no later than 30 days from the date of receipt by the CUSTOMER of the order confirmation e-mail sent by Maria Patrizia Marra Jewels.
For every order placed on www.mariapatriziamarra.com, Maria Patrizia Marra Jewels may issue an invoice for the goods shipped. After the invoice is issued, it will not be possible to make any changes to the data indicated in the invoice.

ARTICLE 9 – Responsibility

Maria Patrizia Marra Jewels assumes no responsibility for inefficiencies attributable to force majeure or fortuitous event, even where dependent on malfunctions and inefficiencies of the internet network, in the event that it fails to execute the order within the time stipulated in the contract.

ARTICLE 10 – Access to the site

The CUSTOMER has the right to access the site for browsing and making purchases. No other use, particularly commercial, of the site or its content is permitted. The integrity of the elements of this site, whether aural or visual, and the related technology used remain the property of Maria Patrizia Marra Jewels and are protected by intellectual property law.

ARTICLE 11 – Privacy Policy

Maria Patrizia Marra Jewels understands the importance of its users’ personal information and therefore intends to inform you and provide you with as much control as possible over the management of personal information collected through our Site.

Please read this Privacy Policy which applies each time you access the Site, even independent of your purchase of the Maria Patrizia Marra Jewels products we sell on the Site.

Some services may be subject to specific legal terms, in which case we will be sure to give you all the appropriate information from time to time.

ARTICLE 12 – Cookie Policy

ARTICLE 13 – Integrity

These General Terms and Conditions of Sale consist of the entirety of their component clauses. If one or more of the provisions of these Terms and Conditions is deemed invalid or declared invalid under law, regulation, or following a decision by a court having jurisdiction, the other provisions shall continue in full force and effect.

ARTICLE 14 – Applicable Law and Jurisdiction.

These Terms and Conditions are subject to Italian law.
Any dispute that is not amicably settled shall be submitted to the exclusive jurisdiction of the Court of the place of residence or domicile of the CUSTOMER, if located in the territory of the State.
In any case, optional recourse may be had to the mediation procedures set forth in Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale.
